6. Consumer Guarantees Act 1993
Nothing in these terms limits your rights under the New Zealand Consumer Guarantees Act 1993. However, as Vinyl Scratch Arcade is a free service, our liability for any disruptions, errors, or loss of virtual Decibels is strictly limited to the maximum extent permitted by New Zealand law.
7. Limitation of Liability
Audiowave Entertainment NZ Limited provides this platform on an 'as is' basis. We do not guarantee uninterrupted or error-free gameplay. We shall not be held liable for any direct, indirect, or consequential damages arising from your use of Vinyl Scratch Arcade or the temporary unavailability of any games.
8. Governing Law and DIA Context
These terms are governed by the laws of New Zealand. Because Vinyl Scratch Arcade involves no real money and requires no purchases, it does not constitute gambling under the New Zealand Gambling Act 2003 and operates outside the regulatory purview of the Department of Internal Affairs (DIA) regarding licensed gambling. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
